Sacramento Prosecutor and Police Face Wrongful Conviction Brady Lawsuit

Sacramento Lawsuit Targets Prosecutor and Police for Fraud In Wrongful Conviction Brady Case
Plaintiff Peter Valladares has filed a multi-million dollar lawsuit in the Sacramento County Superior Court that targets Prosecutor and Police for fraud in а wrongful conviction case. Valladares has claimed in his court documents, in the underlying directly related 2006 criminal court case, that the Prosecutor and Police had suppressed and concealed evidence he was entitled to receive having committed Brady violations (Brady v. Maryland, 1963).
The current lawsuit against individual defendants includes Krista Kastanos, Deputy District Attorney (DDA) for the Sacramento County District Attorney’s Office, and Michael Wood, Detective (Det.) for the Sacramento Police Department and claims that DDA Kastanos failed to provide to Mr. Valladares’ defense attorney credible documentation from his private attorney. These documents included detailed transaction reports of a foreclosure Trustee’s sale properly conducted by Mr. Valladares in Los Angeles County. They were sent to Kastanos before Mr. Valladares’ arrest and represented exculpatory evidence of his innocence.
Court records from 2006 show that in two of Det. Wood’s police reports, he had made several false and fabricated accusation statements appearing to be by a purported witness or victim, whom was the Beneficiary in Los Angeles and quasi-represented by Valladares’ private attorney.
Kastanos then used those false police reports in order to secure the plea deal and wrongful conviction. She then diverted a substantial amount of the Los Angeles Trustee’s sale proceeds to another party thereby having made Mr. Valladares criminally and financially liable to the present in 2018, all under her so-called Brady misconduct, or as Mr. Valladares has re-defined: Brady-fraud.
Valladares further claimed that his own court-appointed defense attorney David Fischer, also a defendant in the lawsuit, had suppressed and concealed documentation that he should have received shortly after his incarceration. Fischer kept Valladares uninformed of the case with no defensive options leading him to submit to their joint plea offer, hence, facilitating Kastanos’ wrongful conviction as well.
“With Brady violation/misconduct cases since 1963 still happening through to today, clearly there’s a problem and no complaint like this one has ever been filed. This fresh lawsuit aims to achieve a US Supreme Court fix to prevent governmental attorneys from engaging in these types of subversive Brady violation tactics going forward, with broader remedies and affirmative corrective measures,” commented Peter Valladares.
